Are these statistics regularly available to the public? Is the owner information available for each of these? What kind of taxes are these foreign based owners paying on the natural resources they are obviously taking or planning to take out of the U.S.? This unnerves me a bit.

Thank you, Julie, for your comment. So often I am asked to write on a certain subject and go for the"how-to" over the "why-to". Scott shared with me the article you mentioned and it definitely presents another side of conservation easement. I'd like to share a couple parts that I found to be particularly potent:

"Don's [McIvor] first clue about the rights he'd given away came only a year after he signed over the easement when he decided to build at home at the base of Blue Mountain...part of Don's remaining 6,500 acres. After construction began, Don heard from his bud, James King, now the program director for [The Nature Conservancy], letting Don know that his easement didn't allow for another home to be built. Don realized he was now a tenant with a landlord."

Julie McIvor states: "The Nature Conservancy continued to use incorrect propaganda to point the finger at ranchers, making us look evil."

As the granddaughter of ranchers on both sides of my family, this really irks me. My grandmother proudly wore a bumper sticker for years stating "Ranchers: the Original Environmentalists." And she meant it.

Ranchers don't over-ranch their land, destroying its viability as an income source! That would be antithetical to the business - like burning down your office building or firing all your employees and then wondering why you couldn't get any work done.

This final quote really hit me hard: "[Don's] son and daughter-in-law know there's nothing they can do to change things now. They are and will forever be only tenants on their family ranch. But they are hell-bent on educating others, particularly ranchers, about understanding the whole scope of conservation easement."

Thanks again for your input, Julie. I encourage you to keep sharing and for others out there to share their opinions on both sides. I know I will continue to expand my understanding of conservation easement and The Nature Conservancy, forming what will inevitably be my own opinion, appreciating all that contributed.

In response to conservation easements I would like to say please do not buy into this scam. We have a conservation easement. The tax deductions are not much and are not worth becoming a tenant on your own land. This country was founded on individual rights and private property. Please do not place this horrible restraint on your children and grandchildren. They will resent you for it. We do. It has caused more problems than solutions. You can read our story in Range Magazine, Spring 2006 Issue "Land Rich, Cash Poor".
It would be wiser to spend time trying to reduce the death tax from our federal government to keep the land in your family.
You can also contact us at 432-426-2277.

My family has land in South Texas near Del Rio and Lake Amistad (pronounced "Am-sted"). My father is getting on in years and we're starting to consider the estate tax ramifications of holding onto this land. Have thought about donating to the National Park, maybe the Texas Nature Conservancy. Your opinion would be appreciated.

Sincerely,
Jimmy Winterbaum
